The shooting on Derby Avenue
Louisville Metro Police officers responded at about 1:45 p.m. on Thursday to a reported shooting in the 200 block of Derby Avenue, in Buechel, just off Bardstown Road and a short walk from Buechel Park. The 911 call came in just before 2 p.m., WLKY reported. Officers found a man outside a residence with gunshot wounds. He was taken to UofL Hospital, where he later died from his injuries. Neighbors told WLKY they heard six shots. Police have not released the man's name.

What the arrest report says
The account in the arrest report, as reported by WDRB and WAVE, comes from a witness and from video. According to the report, the witness saw Kelley and the man in a verbal altercation before Kelley attempted to strike him with a lawn mower, knocking him to the ground. The report said the man got up and walked toward Kelley, who produced a handgun and shot him, and that he fell to the ground. The report said Kelley then walked up to the man and fired multiple rounds at point blank range.
Louisville Metro Police said the witness account is partially corroborated by video of the incident. The details in the arrest report are allegations. Kelley has pleaded not guilty, and Kelley is presumed innocent unless a court finds otherwise.
The case moved quickly on Thursday. The first police account that afternoon said a person had been detained after the shooting, before Louisville Metro Police announced Kelley's arrest and the murder charge. The department's homicide unit is investigating, WHAS11 reported. Police have announced no motive beyond the argument the witness described.
A court date ahead
Kelley was arraigned in court on Friday morning and pleaded not guilty. Bond was set at $250,000, and Kelley is due back in court on November 9. Louisville Metro Police said the investigation remains ongoing.
For the Derby Avenue block, the next public step in the case is that November 9 hearing. Until then, the man who died has not been publicly named, and police have released no further account of the argument the witness described beyond what the arrest report contains.
