Key points

  • Voters in four states decided abortion related ballot measures on Nov 3, 2026, in the midterm elections.
  • Abortion was already legal to a point in both Nevada and Virginia before this vote.
  • Nevada voters approved Question 6.

Voters in four states decided abortion related ballot measures on Nov 3, 2026, in the midterm elections. Ballotpedia reported the results on Nov 4, 2026. Two measures were approved and two were defeated.

Abortion was already legal to a point in both Nevada and Virginia before this vote. The new measures write those protections into the state constitutions. The results extend a pattern that has held since the Supreme Court overturned Roe v. Wade in 2022. Voters in more than 10 states have passed abortion rights measures since that decision.

Nevada approves Question 6

Nevada voters approved Question 6. The measure establishes a constitutional right to abortion until fetal viability. After viability, abortion remains allowed when needed to protect the life or health of the mother.

Question 6 passed with 63.3 percent of the vote with about 85 percent counted.

Nevada requires citizen initiated constitutional amendments to pass in two consecutive general elections. Voters first approved the measure in 2024. The approval on Nov 3, 2026, was the second vote. It completes the process and puts the right in the state constitution.

Virginia approves Question 1

Virginia voters approved Question 1. The measure establishes a constitutional right to reproductive freedom. It includes abortion before the third trimester and afterward under specified circumstances.

The measure also covers prenatal care, childbirth, postpartum care, birth control, miscarriage management and fertility care.

Question 1 passed with 62.4 percent of the vote with about 96 percent counted.

Idaho voters reject Proposition 1

Idaho voters defeated Proposition 1. The measure would have established a statutory right to make private reproductive health care decisions. That right would have included abortion until fetal viability.

Proposition 1 drew 44 percent of the vote with about 96.5 percent counted. The result leaves Idaho law unchanged on this question.

Missouri voters reject Amendment 3

Missouri voters defeated Amendment 3. The amendment would have repealed the constitutional right to reproductive freedom that Missouri voters approved in 2024. It would have prohibited abortion with limited exceptions. It also would have prohibited certain surgical procedures and treatments for transgender minors.

Its rape and incest exceptions would have applied through 12 weeks of gestation.

The amendment was losing 55.5 percent to 44.5 percent with about 98.5 percent of the expected vote counted. Voters rejected it, so the right approved in 2024 stays in place.

A longer record

Ballotpedia notes that voters decided a record 11 abortion related statewide measures in 2024. From 1970 through 2025, voters decided 65 such measures. They approved 27 and defeated 38.

The four results on Nov 3, 2026, add to that record. Nevada and Virginia moved existing protections into their constitutions. Idaho and Missouri left their current law in place after voters turned down the proposals in front of them.
